Credit card debts cannot be enforced by taking control of goods using High Court Enforcement Agents because only a County Court has jurisdiction to determine the enforcement of consumer credit agreements.[1]
The preferred method of recovering consumer creditor debts by banks is to sell the debt to debt collectors.[2]
The debt collector may try getting a County Court judgment against the debtor, but this still does not enable them to recover it using High Court enforcement.[3]
It leaves County Court bailiffs, who are salaried by the Court Service and have no motivation to recover the debt, or keep the creditor appraised of the enforcement progress, even if the enforcement is unsuccessful.
