When you ask the court to withdraw a warrant of control, it is the policy of some court staff to say they cannot withdraw the warrant because of a case called: Hereford and Worcester Ex-parte McRae.[1]
In 2012, Parliament repealed the judgment allowing the court, or a fines officer to withdraw a warrant of control for unpaid court fines.[2]
Court staff sometimes quote Hereford and Worcester Ex-parte McRae as a blanket excuse not to follow a request to withdraw a warrant, hoping the defaulter is less informed of the law.[3]
