Private parking companies cannot fine you, they issues Parking Charge Notices made to look like Regulation Penalty Charge Notices.[1]
Private parking companies use ANPR to get your car registration and send an invoice, called a Parking Charge Notice for the parking charge to the registered keeper address from the DVLA[2] and the parking company must pay a fee for that information.[3]
The vehicle keeper must give the notice to the driver.[4]
If the keeper does not tell the parking company the name of the driver, they may recover the parking charge from the keeper.[5]
Unlike a local authority, a parking company cannot issue a warrant of control for an unpaid parking contravention.[6]
Private Parking companies rely on undefended claims for unpaid parking charges.
Instead, they prefer using common debt collectors and send threatograms.
FORMAL CHALLENGE
If you get a county court claim for an unpaid parking charge, make a formal challenge and it becomes a defended claim.
Pursuing defended claims makes the claim financially toxic for the parking company because they cannot recover solicitors costs.[7]
