Ignore a traffic contravention debt bailiff, what happens next?



If the bailiff cannot take control of goods or the debtor does not have a vehicle to clamp and does not engage with the bailiff, the bailiff will return the case to the creditor after 12 months from the date of issue on the Notice of Enforcement.[1]

The registration of the contravention vehicle is entered into a database and bailiff companies crawl neighbourhoods in ANPR vans looking for them. When a contravention vehicle is found, the bailiff clamps the vehicle for a period of two hours,[2] then removes it to a compound.[3]

If the contravention vehicle is owned by someone who acquired it before the date of the Notice of Enforcement[4] and the bailiff removes it, the new owner can make a third-party claim[5] and recover damages[6] together with their costs.[7][8] However, the law was disregarded by a Judge on the basis the sale of a £6,000 car was a sham[SIC] to avoid paying a parking ticket.[9]

The Notice of Enforcement lapses after a period of 12 months from the date of issue.[10][12] If bailiffs clamp or take a vehicle after the 12-month time limit elapses, the debtor may recover damages for this breach.[13]

Bailiffs enforcing traffic contravention debts do not have authority to break and enter private homes,[13] or commercial premises.[14]
