Where an item which belongs to the debtor is in use by any person at the time at which the enforcement agent seeks to take control of it, the enforcement agent may not do so if such action is in all the circumstances likely to result in a breach of the peace.[1]
A police officer present at the scene must arrest the bailiff for breach of the peace if he witnesses a bailiff placing anyone in fear of violence or harm.[2]
A power to use force does not include power to use force against people.[3]
