Bailiffs are only empowered to take control of goods of the debtor and sell them to pay the debt.[1]
It is common to threaten council tax debtors with prison because the council has the power to apply to the court for a committal order.[2]
Defaulters can be sent to prison for the non-payment of magistrates court fines.[3]
When bailiff know they cannot recover the debt, or get access to the debtor’s goods, they often say the creditor will send them to prison.
