Bailiffs may only take control of goods that belong to the debtor.[1]
The bailiff may only take control of the debtors goods where the debtor usually carries on a trade or business.[2]
Bailiffs do not have a power to search anyone's property to satisfy themselves the debtor does not live there. If bailiffs force their way into someone's property and refuses to leave, even if the address was previously occupied by the debtor, the occupant may sue for damages for £10,000 plus costs.[3]
