Provided the babysitter is over the age of 12 because bailiffs must withdraw without making enquiries if the only persons present are children who appear to be under the age of 12.[1]
If the babysitter is under 16, the bailiff must withdraw from domestic premises if they are the only person present, but the bailiff can ask when the debtor will be home - if appropriate.[2]
If the babysitter is an adult, the bailiff may enter the property,[3] but if the bailiff takes control of goods, the enforcement may be revoked. Bailiffs cannot enter with the help of a third party, or workmen inside the property, because access by this means renders everything that follows invalid.[4]
