The bailiff may not take control of goods in use or being operated, by any person if such action is likely to result in a breach of the peace.[1]
This includes taking control of a vehicle being driven by somebody, or a mobile phone being used to film them.
If a breach of the peace occurs, or a police officer accuses someone of breaching the peace, the enforcement fails.
