The Sale Stage fee applies after the bailiff has taken control of goods[1] and starts removing them for sale.[2][3]
To take control of goods or vehicle belonging to the debtor, the bailiff must do one of the following:[1]
Secure the goods on the premises on which he finds them.
Secure them on a highway, where he finds them or within a reasonable distance.
Remove them and secure them elsewhere.
Make a controlled goods agreement with the debtor.[4][5]
If the bailiff did not take control of goods, the debtor may recover the Sale Stage Fee by applying for a detailed assessment,[6][7] together with costs.[8][9][10]
If the person the money was taken from is not the debtor, he is unable to apply for a detailed assessment, instead, he may recover the money taken by making a claim in the small claims track.[11]
